THE FIFTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE NO. 291/KMK.05/1997 ON BONDED ZONES
THE MINISTER OF FINANCE,
Considering :
- a. that to improve efficiency and competitiveness, several companies having the status as bonded zone operators intend to carry out reconditioning activities in the bonded zones;
- b. that reconditioning activities constitute one of types of manufacturing activities that can be carried out in the bonded zones;
- c. that Decree of the Minister of Finance No.291/KMK.05/1997 on bonded zones as has been several times amended the latest by Decree of the Minister of Finance No.94/KMK.05/2000 has not firmly defined the activity of the manufacturing industry;
- d. that based on the above considerations, it is deemed necessary to stipulate a decree of the Minister of Finance on the fifth amendment to Decree of the Minister of Finance No.291/KMK.05/1997 on bonded zones.
In view of :
- 1. Law No.6/1983 on general provisions and taxation procedures (Statute Book of 1983 No.49, Supplement to Statute Book No.3262) as has been amended the latest by Law No.16/2000 (Statute Book of 2000 No.126, Supplement to Statute Book No.3984);
- 2. Law No.7/1983 on income the (Statute Book of 1983 No.50, Supplement to Statute book No.3263) as has been amended the latest by Law No.17/2000 (Statute Book of 2000 No.127, Supplement to Statute Book No.3985);
- 3. Law No.8/1983 on value added tax and sales tax on luxury goods (Statute Book of 1983 No.51, Supplement to Statute Book No.3264) as has been amended the latest by Law No.18/2000 (Statute Book of 2000 No.128, Supplement to Statute Book No.3612);
- 4. Law No.10/1995 on customs affairs (Statute Book of 1995 No.75, Supplement to Statute Book No.3612);
- 5. Law No.11/1995 on excise (Statute Book of 1995 No.76, Supplement to Statute Book No.3613);
- 6. Government Regulation No.33/1996 on bonded hoarding places (Statute Book of 1996 No.50, Supplement to Statute Book No.3638) as has been amended by Government Regulation No.43/1997 (Statute Book of 1997 No.90, Supplement Statute Book No.3717);
- 7. Presidential Decree No.228/M/2001;
- 8. Decree of the Minister of Finance No.25/KMK.05/1997 on customs procedures in the import sector;
- 9. Decree of the Minister of Finance No.291/KMK.05/1997 on bonded zones as has been several times amended the latest by Decree of the Minister of Finance No.94/KMK.05/2001;
- 10. Decree of the Minister of Finance No.488/KMK.05/1997 on customs procedures in the export sector.
DECISION:
To stipulate :
DECREE OF THE MINISTER OF FINANCE ON THE FIFTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE NO.291/KMK.05/1997 ON BONDED ZONES.
Article 1
Provisions in Article 1 of Decree of the Minister of Finance No.291/KMK.05/1997 on bonded zones as has been several times amended the latest by Decree of the Minister of Finance No.94/KMK.05/2000 shall be amended by inserting point 1a between point 1 and point 2, which reads as follows:
"1a. The activities of processing industry shall be processing raw materials, basic materials, semi-finished goods and/or finished goods into goods with higher value."
Article 2
This Decree shall begin to take effect on the date of stipulation.
